Release of Liability
By purchasing an Aero Concept branded product from or through a United States entity (“AC Entity”), you agree to and expressly assume the risks of injury, damage or liability during or related to possession and/or use of such product. You irrevocably release AC Entity, its employees, contractors, suppliers, distributors, agents, successors, heirs, assigns, affiliates and representatives (“Released Parties”) from all claims, rights, demands or actions for which you or your successors, heirs or assigns may have against the Released Parties in connection with the product. You agree not to make a claim against or sue the Released Parties for injuries or damages relating to the product. You further understand and agree that this release extends to all claims known, unknown, suspected or unsuspected, related to the product and you expressly waive all rights under Section 1542 of the California Civil Code (or any similar law or rule) regarding such claims. Section 1542 states: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.” If any of the foregoing provisions are held to be unenforceable, such provision(s) shall be amended to affect the intended meaning, or in the alternative, be severed from this agreement while the remaining provisions shall be enforced.
